By accessing or using Delvly (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including visitors, registered users, and paying customers.
Delvly is a B2B lead generation tool that allows sales professionals to describe an Ideal Customer Profile (ICP) in plain English and receive a list of business contacts with associated contact data. The Service uses third-party data providers and AI to generate these results.
To use the Service, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Service.
The Service operates on a credit-based system. Credits are purchased via Stripe and are non-refundable once consumed. One credit equals one lead returned by the Service. Credits included in a monthly subscription renew at the start of each billing cycle and do not carry over. Additional top-up credits do not expire.
Delvly reserves the right to change pricing at any time with reasonable notice to existing subscribers.
You agree to use the Service only for lawful business purposes. You may not use the Service to: send unsolicited commercial messages in violation of applicable law; harass, threaten, or harm any individual; violate any applicable data protection or privacy laws; resell or redistribute contact data obtained through the Service without appropriate legal basis.
You are solely responsible for ensuring your use of contact data obtained through the Service complies with applicable laws, including GDPR and CAN-SPAM where applicable.
Contact data provided through the Service is sourced from third-party data providers and is updated periodically. Delvly does not guarantee the accuracy, completeness, or timeliness of any contact data. Results reflect data available at the time of the search and may not reflect subsequent changes.
The Service, including its design, code, and content, is owned by Delvly and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written permission.
To the maximum extent permitted by law, Delvly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid to us in the three months preceding the claim.
Delvly reserves the right to suspend or terminate your account at any time for violation of these terms. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
We may update these terms from time to time. We will notify existing subscribers of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated terms.
